Inquirer: Manuel and Pie Calayan, known as doctors-to-the stars because of their largely show biz clientele, are facing a P26-million lawsuit filed by a Fil-American who accused the couple of botching a penis enlargement procedure he underwent in their clinic last September.
The couple Wednesday submitted their reply to the complaint of Louem Martinez, also known as Louem Boschuk, who claimed his penis was disfigured after the operation.
The Calayans denied any wrongdoing in the separate counter-counter-affidavits they filed at the office of Makati Assistant City Prosecutor Dennis Rafa.
Manuel, who performed the operation, said he had sufficiently informed Martinez about the risks of the procedure, while Pie, who merely accompanied the two during consultations, said she should not have been a respondent in the first place.
In February, Martinez filed a complaint at the Makati prosecutor’s office accusing the couple of estafa, reckless imprudence resulting in serious physical injury, and obstruction of justice.
He said he decided to check out the Calayans’ clinic when he saw their website and arrived in the country in March 2007.
Upon meeting Manuel, he said he got repeated assurances that the procedure, which would use “aquagel” as “dermal filler” to widen the girth of his penis, was safe, and that the doctor had successfully performed the same operation several times.
But after the procedure, which cost him P145,000, excluding miscellaneous fees, he said his penis sagged and was “badly deformed.”
He said Calayan told him the condition was temporary but the symptoms persisted. Martinez said that when he returned to the US, he was told by a physician that using aquagel could lead to cancer.
Martinez said he consulted another doctor, Marcelino Reysio-Cruz Jr., who subjected his penis to an ultrasound “which confirmed that the aquagel has spread from my penis to my scrotum and may develop into tumors.”
He asked for P20 million in actual damages, P3 million in moral damages and another P3 million in exemplary damages.
Manuel, however, said he had carefully explained the “risks, ramifications and complications” involved in the surgical procedure.
“I did not, during the consultation, guarantee to the complainant the success of the procedure nor the results thereof,” he said.
